GENERAL CONDITIONS

 

Print Purchases


The purchase of a BlakeDAWSON print is subject to the following general conditions

The prices are quoted without tax, in Euros. All listed prices are susceptible to revision on the basis of economic fluctuations prior to a signed contractual agreement or confirmed Order of Purchase.

Shipping costs other than in country registered mail are chargeable to the client.

Purchase Orders must be accompanied by full payment, by check or inter-bank wire transfer, as stipulated on the invoice.

Any complaint should be made within one week of reception of the work, and any print deemed unsatisfactory should be returned, with explanation of the concerns, in this same period. Possible disputes must be arbitrated within the jurisdiction of Blake Dawson’s place of residence. Slight variations in color and contrast with the on-line presentation of the image may exist due to variations in computer screen color representation and/or the printing process itself; such variations do not constitute grounds for litigation.

 

Photographic Services


Blake Dawson’s photographic services are subject to the following general conditions:

The prices are quoted without tax, in Euros. All listed prices are susceptible to revision on the basis of economic fluctuations prior to a signed contractual agreement or confirmed Order of Purchase.

Shipping costs other than in-country registered mail are chargeable to the client.

All photo shoots must be contracted in writing with a Photo Assignment Order Form, signed by the client. Any work executed outside the usual work hours: 9.00 am to 18.30 pm from Monday till Friday, entails a supplement, determined at the moment of ordering.

Any alteration by the client of the work description, as described in the original estimate, may alter the cost of the photos or shoot.

Any major catastrophe, electrical power cuts, public strikes, severe weather conditions, etc. which prevents the photographic work, cannot be considered the responsibility of the photographer.

Any cancellation of contracted work, requires notification in writing. A 30% cancellation fee will be charged for all notification prior to 48h before the scheduled shoot, 50% if prior to 24h, and 100% of the job will be charged for any same day cancellation.

Any orders inferior to 800 euros must be paid in full at the moment of invoice reception. Above this sum, all orders must be paid within 30 days of invoice reception. There is a 13% surcharge for payments made after the 30 day period (under French law, # 92-1442 of 31.12.1992). If important technical fees are involved, their full payment must be made by the client at the moment of ordering. Payment by check or inter-bank wire transfer is accepted, as stipulated on the order form.

The copyrights are "all rights reserved" under all international legislations, except when expressly written and given special license on the invoice.

Any complaint should be made within one week of reception of the work, and any photos deemed unsatisfactory should be returned with explanation of the concerns in this same period. Possible disputes must be arbitrated within the jurisdiction of the photographer’s place of residence. Slight differences in color and contrast with the original subject may exist due to technical limitations in the printing process and do not constitute grounds for litigation.

According to the French law number 80 of March 12, 1980, the delivered works remain the property of the photographer until full payment is received. The photographs are subjected to the French Image and Intellectual Property Law of March 11th 1957, no matter the client’s nationality. The nonpayment of the photographer’s work entails the denunciation of the agreement of transfer of author rights, effective immediately, forbidding exploitation of said photos, as protected under copyright law. The non payment of a photo’s rights will fall under the French laws for “counterfeit,” and any material (magazines, brochures, packaging, etc..) showing said photo will be immediately seized (at the client’s expense).

The mention "Photo © Blake Dawson" must accompany all published photos.

One copy of any publication using a Blake Dawson photo must be delivered to the author by the client.

The photographer retains the right to use all photos he has taken for a client, for his personal use and promotion on paper, internet book and website; unless a previously established confidentiality agreement is signed by both parties.

The client/diffuser is responsible for the use of the photos; all pornographic, immoral or defamatory use is not permitted. It is the client’s responsibility to negotiate for and attain all necessary copyrights for people, buildings, works of art, and trade marks present within the photos.
